Master Terms of Service

Terms of Service

Effective Date: July 25, 2026. These legally binding Terms govern your subscription and operational use of BrandedClaws.

1. Acceptance of Terms

By registering an account, purchasing a subscription tier, accessing the API, or utilizing any feature of the BrandedClaws Platform, you ("Customer", "User", or "Subscriber") agree to be bound by these Master Terms of Service.

2. Account Eligibility & Multi-Tenant Workspaces

Subscribers must be at least 18 years of age or a legally registered business entity. Each account owner is responsible for maintaining the confidentiality of workspace API keys, passwords, and user access permissions.

3. Subscription Tiers & Multicurrency Billing

Subscriptions are billed on a recurring monthly or annual basis (with annual subscriptions reflecting an automatic 20% discount). Payments are processed securely via approved gateways (Stripe, Paystack, Flutterwave, or bank wire transfer).

Refund Policy: Subscriptions carry a 14-day risk-free money-back guarantee for initial signups. Renewal payments are non-refundable once billed.

4. 100% Content Ownership & License Grants

✓ 100% Full Intellectual Property Ownership

You retain 100% full legal ownership, copyright, and commercial exploitation rights to all AI copy, 8K media assets, videos, custom audio speech files, and blog articles generated within your BrandedClaws workspace.

5. Acceptable Use & Anti-Spam Enforcement

Users are strictly prohibited from utilizing BrandedClaws for:

  • Sending unsolicited bulk commercial emails (CAN-SPAM / GDPR violation).
  • Generating fraudulent, malicious, deceptive, or defamatory content.
  • Attempting unauthorized reverse-engineering of server endpoints or API routes.

6. SLA & Service Uptime Commitments

BrandedClaws maintains a 99.9% uptime SLA for core workspace endpoints and API routers, excluding scheduled maintenance windows announced at least 24 hours in advance.

7. API & Metered Limits Policy

Subscription plan tiers include metered monthly caps for AI media generation, outbound emails, and voice speech minutes. Exceeding metered limits throttles additional invocations until the next monthly billing cycle or until tier upgrade.

8. Termination & Account Data Export

You may cancel your subscription at any time via your billing dashboard. Upon cancellation, your workspace remains accessible until the end of your prepaid billing period. Following termination, you have 30 days to export your database records before full deletion.

9. Limitation of Liability

To the maximum extent permitted by applicable law, BrandedClaws shall not be liable for any indirect, incidental, special, or consequential damages resulting from platform downtime, third-party API provider failures, or unbacked data loss. Total liability shall not exceed the total fees paid by Customer during the 12 months preceding the claim.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable corporate laws. Any legal disputes shall be settled through binding arbitration.
